1. Purpose of the Website
AAGPBL is a nonprofit organization dedicated to researching, collecting, documenting, preserving, and promoting the history and legacy of the All American Girls Professional Baseball League and the women who participated in it, providing opportunities for interaction among Association members, disseminating historical and educational information, and supporting the continued growth of girls' and women's baseball.
The Website provides historical and educational information, photographs and archival material, player information, Association news, membership information, event information, articles, resources, links to merchandise and third-party services, donation opportunities, and other materials related to the Association's mission.
2. Acceptance of These Terms
Your use of the Website constitutes your acceptance of these Terms.
Certain activities may also be subject to additional terms, policies, rules, agreements, waivers, registration requirements, or notices. These may include:

Submitting an application, request, inquiry, or other form through the Website does not, by itself, create an employment, volunteer, internship, contractual, agency, sponsorship, endorsement, appearance, or other relationship with AAGPBL.
If additional terms apply to a particular activity, those terms will govern that activity to the extent they conflict with these general Website Terms.
The Association's Articles of Incorporation, Bylaws, duly adopted policies, and other governing documents control matters relating to the internal governance of the Association and membership rights.
3. Changes to These Terms
AAGPBL may revise these Terms periodically.
The current version will be posted on the Website with the applicable "Last Updated" date. Changes become effective when posted unless otherwise stated.
Your continued use of the Website after revised Terms become effective constitutes your acceptance of the revised Terms.
4. Use by Minors
The Website contains historical and educational information intended to be accessible to a broad audience, including students and young people interested in baseball history.
Minors may view publicly available Website content. However, a minor should have the permission and supervision of a parent or legal guardian before submitting personal information, making a payment, registering for an event, making a donation, applying for membership, or entering into any transaction through the Website.
Nothing in these Terms is intended to authorize a minor to enter into a transaction that the minor is not legally permitted to enter.
Volunteer and internship opportunities may have minimum age requirements established by AAGPBL based upon the nature of the position, applicable law, insurance requirements, event requirements, or other considerations.
Applicants under 18 years of age may be required to obtain written permission from a parent or legal guardian before participating in an internship, volunteer assignment, event, or other Association activity.
Submission of an application by a minor does not guarantee eligibility or acceptance into any AAGPBL program.
5. Permitted Use
AAGPBL grants you a limited, revocable, nonexclusive, nontransferable right to access and use the Website for lawful personal, educational, research, and informational purposes, subject to these Terms and any restrictions accompanying particular materials.
Except where otherwise stated, you may view Website content and may print or download a reasonable amount of material for your own personal, noncommercial, or educational use.
This permission does not transfer ownership of any content or intellectual property to you.
Any use beyond the permission granted in these Terms may require advance written authorization from AAGPBL or another applicable rights holder.
6. Intellectual Property

Copyright, trademark, publicity, privacy, contractual, licensing, and other rights may apply to these materials.
The presence of material on the Website does not mean that the material is in the public domain or available for unrestricted use.
7. Historical Photographs and Archival Materials
AAGPBL's historical and archival collections are an important part of the Association's mission.
Unless otherwise indicated, Website visitors may make a limited copy of Website material for their own personal, educational, or noncommercial research use where permitted by applicable law and these Terms.
You may not, without appropriate authorization:
- Republish historical photographs or archival materials on another website;
- Reproduce materials in a book, magazine, documentary, film, publication, exhibit, product, or commercial presentation;
- Sell copies of photographs or other Website content;
- Incorporate Website material into merchandise;
- Create or sell reproductions based upon Website photographs or archival material;
- License or sublicense Website material to another person;

- Remove copyright, attribution, watermark, credit, or rights-management information; or
- Represent Website material as your own.
Educational or personal use does not automatically authorize redistribution, publication, commercial exploitation, or the creation of derivative products.
Nothing in these Terms limits rights that cannot legally be restricted, including applicable rights under copyright law such as fair use.
8. Third-Party Archival Materials
AAGPBL may possess physical or digital copies of materials for historical or preservation purposes without owning every intellectual-property right associated with those materials.
Accordingly, AAGPBL cannot grant rights it does not own or control.
A photograph, document, article, recording, or other historical item appearing on the Website may be owned by a photographer, author, player, family, museum, archive, publisher, or another rights holder.
Anyone seeking to reproduce or commercially use such material is responsible for determining the applicable rights and obtaining all required permissions.
Permission from AAGPBL does not constitute permission from another rights holder unless AAGPBL expressly states in writing that it has authority to grant those rights.
9. AAGPBL Names, Logos, and Trademarks
The names, logos, designs, trademarks, service marks, and other branding associated with the All American Girls Professional Baseball League Players Association may constitute protected intellectual property.
Nothing on the Website grants a license to use an AAGPBL name, logo, trademark, design, or other branding for commercial, promotional, fundraising, merchandising, sponsorship, or endorsement purposes.
Without prior written authorization, you may not use AAGPBL intellectual property in a manner that:
- Suggests AAGPBL sponsors, endorses, approves, or is affiliated with a product, organization, event, person, or service;

Nothing in this section prohibits accurate editorial or factual references to AAGPBL or other uses permitted by applicable law.
Requests for trademark or content permission should be submitted through the Website's Contact Us page.
10. Player Names, Images, Voices, and Likenesses
The Website contains information and imagery concerning current and former players, League personnel, Association members, family members, volunteers, and other individuals.
Access to the Website does not grant any right to commercially exploit a person's:
- Name;
- Photograph;
- Image;
- Voice;
- Signature;
- Likeness;
- Personal history;
- Biography; or
- Other attributes of identity.
Publicity, privacy, copyright, contractual, or other rights may be held by the individual, the individual's estate or family, AAGPBL, a photographer, or another rights holder.
Anyone contemplating commercial, promotional, advertising, merchandising, endorsement, synthetic-media, or similar use is responsible for obtaining all rights and permissions required by law.
11. Artificial Intelligence, Automated Collection, and Data Mining
Except with AAGPBL's prior written authorization or as otherwise permitted by law, you may not use automated systems to systematically extract, harvest, reproduce, or compile Website content for purposes including:
- Building commercial databases;
- Training or developing artificial intelligence or machine-learning systems;
- Creating image-recognition or facial-recognition datasets;
- Developing digital replicas of players or other individuals;
- Training synthetic voice, image, video, or likeness systems;
- Creating generative models using AAGPBL archival material;
- Bulk collection of photographs, biographies, player records, or other content; or
- Republishing substantial portions of the Website through another service.
You may not use Website materials to create deceptive or unauthorized synthetic representations of any player or other person, including fabricated photographs, video, audio, speech, interviews, endorsements, or statements.
Ordinary indexing of publicly accessible Website pages by legitimate general-purpose Internet search engines in accordance with applicable Website instructions is not prohibited by this section.
12. Prohibited Conduct
When using the Website, you agree not to:
- Violate any applicable law or regulation;
- Attempt to gain unauthorized access to the Website, server, database, administrative system, or another user's information;
- Interfere with the Website's operation or security;
- Introduce malware, viruses, malicious code, or harmful software;
- Circumvent technological or access restrictions;

AAGPBL may restrict or terminate access to the Website when it reasonably believes these Terms have been violated.
13. Membership Applications and Dues
The Website may permit individuals to apply for, renew, or pay dues for Association membership.
Submitting an online membership application or payment does not independently create rights beyond those provided under the Association's governing documents and applicable membership policies.
Membership classifications, qualifications, voting rights, dues, renewal periods, eligibility, and other membership matters are governed by the Association's Bylaws and duly adopted policies.
If Website information concerning membership conflicts with the Association's governing documents, the governing documents control.
Unless otherwise stated or required by law, membership dues are not refundable after membership has been processed.
AAGPBL may use third-party payment processors to process online dues. Payment information provided to a third-party processor is also subject to that provider's terms and privacy practices.
14. Donations
The Website may permit individuals or organizations to make charitable contributions or other donations to AAGPBL.
Donations must be made using a payment method the donor is authorized to use.
Unless otherwise stated or required by law, completed donations are nonrefundable. AAGPBL may, in its discretion, correct an accidental duplicate transaction or other demonstrated payment error.
Any statement concerning the tax treatment of a contribution is informational only. Donors should consult their own tax professional regarding deductibility or other tax consequences applicable to their circumstances.
15. Events, Reunions, and Tickets
The Website may provide information about reunions, meetings, ceremonies, appearances, baseball events, fundraising events, and other programs.
Events may be governed by separate registration terms, ticket conditions, venue rules, cancellation policies, codes of conduct, media policies, waivers, or other event-specific requirements.
Event schedules, locations, participants, speakers, former-player appearances, programs, and activities may change due to circumstances beyond AAGPBL's control.
Unless expressly guaranteed in writing, the appearance of any particular player, guest, speaker, team, performer, or other participant is not guaranteed.
Event-specific terms control over these Terms with respect to the applicable event.
16. Merchandise and Third-Party Sellers
The Website may contain links to merchandise offered by authorized or third-party vendors.
Unless the Website expressly states otherwise, merchandise offered through an outside retailer is purchased directly from that retailer rather than from AAGPBL.
Pricing, shipping, returns, refunds, product availability, warranties, taxes, payment processing, and other transaction terms may be governed by the retailer's own policies.
A link to an authorized merchandise provider does not give any other person or business permission to manufacture or sell merchandise using AAGPBL intellectual property.

The Website may contain links to museums, archives, news organizations, baseball organizations, social media platforms, payment processors, merchandise sellers, ticketing providers, sponsors, partners, and other third-party websites or services.

AAGPBL does not control third-party websites and is not responsible for their content, availability, security, privacy practices, products, services, or policies.
A link does not necessarily constitute an endorsement unless AAGPBL expressly states otherwise.
Your use of a third-party website is governed by that third party's own terms and policies.
18. User Communications and Submitted Materials
The Website may allow individuals and organizations to submit applications, requests, inquiries, historical information, corrections, stories, photographs, articles, documents, event proposals, volunteer applications, internship applications, appearance requests, or other materials.
Submission of any form through the Website constitutes a request for consideration only unless AAGPBL expressly states otherwise in writing.
Submission of a form does not obligate AAGPBL to:
- Accept an applicant;
- Offer a volunteer position;
- Offer an internship;
- Provide compensation;
- Provide academic credit;
- Attend or participate in an event;
- Arrange for a player or representative to attend an event;

- Provide funding or reimbursement;

Applicants and requestors must provide information that is accurate and complete to the best of their knowledge.
AAGPBL may request additional information when reasonably necessary to evaluate an application or request.
Submitting photographs, articles, historical records, stories, video, audio, or other creative or archival material to AAGPBL for consideration does not, by itself, transfer ownership of that material to AAGPBL.
It also does not automatically grant AAGPBL unrestricted publication, licensing, merchandising, commercial, or other intellectual property rights.
AAGPBL may require a separate permission, release, license, publication agreement, assignment, or other written authorization before publishing or otherwise using submitted material.
You represent that you will not knowingly submit material in a manner that violates another person's copyright, privacy, publicity, contractual, or other legal rights.
AAGPBL is not obligated to publish, retain, return, archive, or respond to unsolicited materials.
19. Volunteer Applications and Volunteer Service
The Website may permit individuals to apply for volunteer opportunities with AAGPBL.
Submission of a volunteer application is an application for consideration only. It does not guarantee that an applicant will be interviewed, selected, assigned to a particular position, or accepted as a volunteer.
AAGPBL may consider factors including an applicant’s experience, interests, availability, qualifications, references, organizational needs, potential conflicts of interest, the requirements of a particular assignment, and other appropriate factors when selecting volunteers.
Where appropriate and permitted by law, AAGPBL may request references or other information reasonably necessary to evaluate a volunteer applicant. Any background screening requiring separate authorization will be conducted only after obtaining any authorization required by applicable law.
Unless AAGPBL expressly agrees otherwise in writing, volunteer service is undertaken voluntarily and without expectation of wages, salary, employment, or other compensation.
Authorized reimbursement of approved expenses, provision of meals, event admission, Association materials, recognition items, or other incidental benefits does not by itself establish an employment relationship.
A volunteer is not authorized to enter into contracts, incur obligations, make commitments, issue official statements, grant permissions, spend Association funds, use Association accounts, or otherwise bind AAGPBL unless the volunteer has received specific authority to do so.
Accepted volunteers may be required to agree to additional policies or agreements concerning matters such as:
- Confidentiality;
- Conflicts of interest;
- Codes of conduct;
- Intellectual property;
- Access to Association systems or records;
- Protection of personal information;
- Social media;
- Media communications;
- Financial controls;
- Event conduct;
- Records management; and
- Other responsibilities associated with the volunteer’s assignment.
AAGPBL may change, suspend, reassign, or discontinue a volunteer assignment when it determines that doing so is appropriate for the Association.
Nothing submitted through the Website creates a guarantee concerning the length, nature, responsibilities, or continuation of any volunteer assignment.
20. Internship Applications and Internship Programs
The Website may permit students and other individuals to apply for internships with AAGPBL.
Submitting an internship application does not create an employment relationship and does not guarantee:
- Acceptance into an internship;
- An interview;
- Compensation;
- Academic credit;
- A particular number of hours;
- A particular assignment;
- Continued participation for a specific period;
- Future employment;
- Future volunteer service; or
- Any other benefit.
The specific nature of an internship, including whether it is paid or unpaid, its educational objectives, duration, schedule, supervision, responsibilities, academic credit requirements, and other conditions, will be determined separately for each internship and, where appropriate, documented in a written offer, internship agreement, or other program documentation.
Nothing in these Website Terms is intended to classify an individual as an unpaid intern when applicable law requires that the individual be treated as an employee or otherwise compensated.
Applicants seeking academic credit are responsible for identifying the requirements of their school, college, university, or educational program. AAGPBL may determine whether it is willing and able to satisfy those requirements before accepting an internship placement.
An internship applicant may be required to provide information concerning:
- Education;
- Academic program;
- Skills and experience;
- Areas of interest;
- Availability;
- References;
- Educational objectives;
- School requirements; and
- Other information reasonably related to the internship.
Accepted interns may be required to sign separate agreements or policies addressing confidentiality, intellectual property, access to historical records, protection of personal information, conflicts of interest, technology use, codes of conduct, and other matters associated with their assignments.
An intern is not authorized to enter into agreements, make commitments, grant rights, make official statements, represent themselves as an officer or authorized spokesperson of AAGPBL, or otherwise bind the Association unless expressly authorized to do so.
AAGPBL may modify or discontinue an internship program or placement subject to applicable law and any applicable written agreement.
21. Event, Appearance, and Participation Requests
The Website may permit individuals, teams, leagues, museums, educational institutions, nonprofit organizations, businesses, event organizers, media organizations, governmental entities, and others to request participation by AAGPBL, its representatives, or individuals associated with the history of the All American Girls Professional Baseball League.
Requests may include, for example:
- Player appearances;
- Speaking engagements;
- Ceremonies;
- Reunions;
- Baseball events;
- Youth baseball events;
- Educational programs;
- Museum or historical programs;
- Interviews;
- Panel discussions;
- Exhibitions;
- Community events;
- Media appearances;
- Commemorations; or
- Other programs involving AAGPBL.
A Request Is Not a Confirmation
Submitting an event or appearance request does not constitute acceptance, approval, or confirmation by AAGPBL.
An event or appearance is not confirmed unless an authorized representative of AAGPBL provides written confirmation.
Discussions, preliminary communications, availability inquiries, form submissions, or tentative expressions of interest should not be treated as confirmation.
No Guarantee of a Particular Participant
AAGPBL cannot guarantee the participation or appearance of any particular Original Player, former player, family member, officer, director, representative, volunteer, speaker, or other individual unless expressly confirmed in writing.
Participation may be affected by availability, travel, health, personal circumstances, event conditions, scheduling conflicts, weather, transportation, or other circumstances.
Public Announcements
Unless AAGPBL has provided written authorization, an event organizer may not publicly announce or advertise that:
- AAGPBL will participate;
- A particular player or representative will attend;
- AAGPBL sponsors or endorses the event;
- AAGPBL is an event partner; or
- AAGPBL has approved the event.
Once participation has been confirmed, event organizers may use only those names, descriptions, photographs, logos, or promotional materials specifically authorized for that purpose.
AAGPBL Intellectual Property
Submitting an event request does not grant permission to use AAGPBL’s:
- Name;
- Logo;
- Trademarks;
- Historical photographs;
- Player photographs;
- Website content;
- Graphics;
- Archival materials; or
- Other intellectual property.
Permission to use such material must be granted separately or expressly included in written event approval.
Player Names and Likenesses
Approval by AAGPBL to participate in an event does not automatically give an event organizer the right to commercially use a player’s name, photograph, signature, image, voice, likeness, or other attributes of identity.
Additional permission from the player, an authorized representative, another rights holder, or AAGPBL may be required depending upon the proposed use.
Information Provided by Event Organizers
Anyone submitting an event request represents that the information provided is accurate to the best of their knowledge and that they have authority to submit the request on behalf of the identified organization when submitting it in an organizational capacity.
Event organizers should disclose material information reasonably necessary for AAGPBL to evaluate participation, including, where applicable:
- Event date and location;
- Nature and purpose of the event;
- Expected attendance;
- Requested participants;
- Requested activities;
- Public or private status of the event;
- Admission charges;
- Fundraising activities;
- Sponsorship arrangements;
- Media coverage;
- Photography or recording plans;
- Travel requirements;
- Lodging requirements;
- Accessibility considerations;
- Security considerations; and
- Any proposed commercial use of AAGPBL or player intellectual property.
Material changes to an event after approval should be promptly disclosed to AAGPBL.
Expenses and Financial Commitments
Submission or approval of an event request does not obligate AAGPBL to pay travel, lodging, meals, transportation, appearance fees, shipping, event production expenses, or other costs.
Responsibility for expenses must be separately agreed upon in writing.
An event organizer may not incur expenses in AAGPBL’s name or represent that AAGPBL will pay an expense without prior written authorization.
Safety and Event Conditions
AAGPBL may decline, modify, or withdraw participation when reasonably necessary because of safety concerns, accessibility concerns, weather, travel disruptions, health considerations, material changes to the event, misrepresentation by an organizer, inappropriate use of Association intellectual property, or other circumstances affecting the Association or its participants.
Where appropriate, AAGPBL may require additional event documentation, insurance information, releases, accessibility arrangements, security arrangements, transportation arrangements, or other reasonable safeguards before confirming participation.
No Agency Relationship
An event organizer does not become an agent, representative, partner, joint venturer, employee, or authorized spokesperson of AAGPBL merely because AAGPBL agrees to participate in an event.
Unless expressly authorized in writing, an event organizer has no authority to make commitments or representations on behalf of AAGPBL.
22. Information Submitted Through Applications and Requests
Information submitted through volunteer applications, internship applications, event requests, membership forms, contact forms, and other Website forms may be used by AAGPBL for legitimate Association purposes related to the submission.
Depending upon the nature of the request, information may be reviewed by appropriate AAGPBL officers, directors, committee members, coordinators, volunteers, professional advisors, or other individuals involved in evaluating or administering the applicable activity.
For an event or appearance request, relevant information may also be shared with the person whose participation is requested, a family member, representative, event coordinator, or other person reasonably involved in determining availability or arrangements.
Submission of an application or request does not authorize AAGPBL to sell the applicant’s personal information.
Collection, use, retention, protection, and disclosure of personal information are also subject to AAGPBL’s Privacy Policy.
Applicants and requestors should not submit highly sensitive personal information unless it is specifically requested and reasonably necessary for the applicable purpose.
23. Suggestions and Corrections
AAGPBL welcomes good-faith corrections and additional historical information.
Because the Website documents events and individuals from many decades ago, historical records may conflict, and additional information may become available over time.
Providing a factual correction or suggestion does not guarantee that AAGPBL will adopt or publish the requested change.
AAGPBL may evaluate historical claims using records, archival sources, firsthand accounts, publications, photographs, and other information it considers appropriate.
24. Historical Accuracy
AAGPBL makes reasonable efforts to provide accurate historical and factual information. However, the Website contains information derived from historical records, personal recollections, archival documents, publications, third-party sources, and materials collected over many years.

TO THE FULLEST EXTENT PERMITTED BY LAW, AAGPBL AND ITS OFFICERS, DIRECTORS, MEMBERS, VOLUNTEERS, REPRESENTATIVES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE.
This includes damages arising from:
- Reliance upon Website content;
- Website interruptions or technical problems;
- Third-party websites or services;
- Unauthorized access resulting from circumstances outside AAGPBL's reasonable control;
- Loss of data;
- Use or misuse of historical information; or
- Products or services provided by third parties.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded.
31. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless AAGPBL and its officers, directors, representatives, volunteers, and agents from claims, damages, liabilities, judgments, costs, and reasonable attorneys' fees arising from your:
- Material violation of these Terms;
- Unlawful use of the Website;
- Unauthorized use of AAGPBL intellectual property;
- Submission of material that infringes another person's rights; or
- Fraudulent, malicious, or intentionally wrongful conduct involving the Website.
This provision does not require indemnification to the extent a claim results from AAGPBL's own conduct for which indemnification cannot lawfully be required.
32. Suspension or Termination of Website Access
AAGPBL may suspend, restrict, or terminate access to all or part of the Website when reasonably necessary to:
- Protect Website security;
- Address unlawful activity;
- Enforce these Terms;
- Prevent misuse of Association intellectual property;
- Protect another person;
- Perform maintenance; or
- Discontinue a Website feature or service.
AAGPBL is not obligated to maintain any particular Website feature indefinitely.
33. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles, except where federal law or another applicable law controls.
Subject to any jurisdictional requirements imposed by applicable law, any legal proceeding arising from or relating to these Terms or the Website shall be brought in a court of competent jurisdiction located in the State of Michigan.
34. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.
35. No Waiver
AAGPBL's failure to enforce a provision of these Terms on one occasion does not waive its right to enforce that provision or any other provision later.
36. Entire Agreement Regarding Website Use
These Terms, together with any policies or additional terms expressly incorporated into them, constitute the agreement between you and AAGPBL concerning general use of the Website.
These Terms do not replace the Association's Bylaws, Articles of Incorporation, contracts, licenses, event agreements, membership rules, media policies, or other specific agreements where those documents govern a particular relationship or activity.
